Introduction

  • New Year’s Eve Oakland California at the BART train station
  • Oscar decided to take the train out to the city to see fireworks. He didn’t want to drive because he knew that he and his friends would be drinking.
  • Officer Mehserle shot and killed Oscar Grant   

 

Body #1

  • California has a history of rioting and police brutality.
  • Police brutality is when police officers abuse their power. They pull out Tasers, beat people both verbally and physically, and allow the law to go out of their mind for the moment.   
  • Police brutality has been an issue for years now, many officers have walked free of sentence after either beating or killing someone.
  • Many officers have gotten off easy if not free because their plea is that whatever they did was a mistake. Officer Mehserle for example, his plea is that he meant to reach for his taser not his gun.
  • Reviewing the rules of an officer carrying a gun, it is made clear that the gun must have the safety on. How did Mehserle take his gun out and take it off safety without realizing it wasn’t his taser?
  • Since previous officers has gotten off with the “mistake” excuse, I’m pretty sure officer Mehserle figured the same.

  • A paramedic from that night came forward once he realized some things from that night.
  • The paramedic said that officers did not call for a paramedic until minutes later, none of the officers applied pressure to Oscars bullet wound and after shooting Oscar in the back officer Mehserle just handcuffed and left him there.
  • Once the BART police department noticed that he was trying to look into the situation more, they stopped paying him forcing him to have to quit.

  • Officer Mehserle was seen showing no type of remorse in the court room and after the verdict.
  • He got two years in prison but only served eleven months. After hearing the verdict Mehserle still feel like he should’ve gotten off and complained about the sentence he received.
  • I result to those light sentence, the people of Oakland California was not happy at all. Riots and protest broke out immediately after. That people would not stand quiet about this issue any longer. By the damage that was done and the anger that was expressed, it was clear that the people were fed up with the police.

 

Conclusion

  • To think, the police is supposed to protect us citizens and follow the law. Its to the point where people would rather not be bothered by them, people would rather handle things in their own hands because the police are just not trustworthy in the people’s eyes anymore. People have built up anger and fear towards the people who they should feel like they can call at any time and have protection. These days, you just don’t know what the results will be with an officer on the scene.
  • Police brutality doesn’t look like it’s coming to an end any time soon.
  • It is up to the people to unmute them and speak up and take action for what we know is right and wrong.
  • It is up to the head of the police departments to make sure that there are making officers face consequences for their wrong doing. It was never but most definitely no longer acceptable for officers to get away with taking matter into their own hands and going against the law. Everyone isn’t blind; we all know that there is a problem here. It’s just the matter of who will stop it. 

BLOG POST 6 + 7 – BART Police Shooting of Oscar Grant

         Officer Mehserle shooting Oscar Grant is the actual triggering event of the BART shooting of Oscar Grant, pretty self-explanatory. However, the direct cause is much deeper. The direct cause of this conflict is simply police brutality. There have been many incidents where policemen could have blood all over their hands and still get off easy or completely. This conflict blew up and was dragged on because there has been so many “accidental killings”, majority of African American males at that. Like many other officers, Officer Mehserle claimed to have been reaching for his Taser to tase Grant, not his gun to shoot him. Mehserle’s attorney Michael Rains backs the officer up on his accidental claim and says “In California … we know that police officers have made this same accident in nine other cases, there have been no other criminal prosecutions. This was an accident, not a crime.” (Rains, 2013, p.1). By attorney Rains saying that, it’s clear that both Mehserle and his attorney went in to the court room almost positive he would get off easy just because other officers in the past has. Others have walked free why not his client? By officers not being punished for their actions, it’s like giving officers the okay to just murder people if they say that it was just an innocent mistake.

              In many recordings by witnesses from that night, officer Mehserle and other officers on the scene were shown abusing their power and heard threatening Oscar and his friends. Abuse of power by police much known as police brutality is the direct cause of this conflict. There was a lot of unfairness on the scene that night. Oscar Grant and his friends were saying curse words and showed that they were upset for being singled out and harassed by the officers. However, they never tried to fight back, only a few resisted arrests. Oscar Grant on the other hand, was one of the few who did not resist he in fact was trying to explain himself respectfully with both hands up where officers could see them. As videos show and witness explained, officers use Oscar’s softness as a demonstration in a way to his friends. Oscar was not a threat to the policemen, so they used him and punched him repeatedly, kneed him in his back and neck to show his friend that they were serious. They did it to prove themselves; also safe to say that Oscar lost his life to prove that the police meant business that night. A paramedic from that night, Sheehan Gillis decided to do an investigation that night. Mainly because, the paramedics were not given word that Oscar Grant was shot. None of the officers applied pressure to the wound to stop the bleeding or anything. Oscar was left there until the officers were ready for him to be treated. Even when reached by the paramedics, only one of two wounds was treated properly. Even after Oscar was shot, he wasn’t treated fairly. The officers on the scene that night didn’t care if he lived or died. Because of how race maybe or even just because some of his friends were talking back to the officers, they left him to die. After paramedic, Dr. Gills realized the mistreatment, he decided to investigate. Not too long after, he was ordered to stop his investigation. What were officers trying to hide? The paramedic still didn’t keep quiet about his suspicion. He pay then started to become lower and some weeks he wouldn’t even get paid at all. Dr. Gills eventually left for financial reasons. This is proof that the BART policemen are in fact hiding something and they drove the one inside person who was willing to speak and investigate it away.

               The article focuses on how the law is supposed to reduce violence and be so against it, yet they bring it into the world themselves. The writer states that the law itself is a kind of violence and that the decision making could exert violence both physical attacks and inner violence which reflects back to my conflict. The officer who shot the victim in my conflict made a decision along with a judgment, a judgment who most define as a racial thing. The purpose that the officer gives about even confronting the victim was because he was bringing violence to citizens however, was it right to fight violence with violence? No. in an end result, there was a dead body on sight, Oscar Grant. Because of the incident, there then were riots, protests, many which ended in violence and plenty of deaths. The law doesn’t grasp the fact that their actions and decisions that they make will have an effect on future events. If the one officer of the “law” genuinely wanted to follow the law and make the streets a better and safer place, he would have played that incident out differently. This just goes to show how much the “law” is being valued or just human rights in general. Which is exactly what the reader is trying to get across, officers often time abuse their power. In the article it is made clear that there are people out here that are seeing the true colors of the law. The law is here to protect us not to kill us off themselves.

 

              I chose this article because it focuses on two of the themes that my conflict is categorized under, violence and law. The only thing the article talks about is the abuse of the law and the loose ends of reasons why most officers leave a scene with a dead body on their hands. It tells how officers contradict the law every day. This article was really helpful for me because I always thought that it was only family or friends that have lost someone to a law abusing policeman that saw the blurs of the law but it’s not. Everyone is aware of what is going on its just a question now of what’s going to be done about it, whose voice will be heard. Even though I know some actual stories about how policeman fought violence with violence or just didn’t reflect the law so well, I think for other readers who would come across this it would be helpful to provide some examples.

        This article focuses on the side that shows no sympathy for the death of Oscar Grant. The author of the article is saying that a movie that was recently put out based on the last hours of Oscar
Grants life was a cry out for pity. He says that it was purposely put out right before the verdict of Trayvon Martin’s case was found to gain sympathy. He really didn’t see the bigger picture or reason behind the movie. The purpose was to get the story out there, to not have Oscar Grants life forgotten, and to have what many thought was unjust publicized.

 

             I chose this article because it just shows the people who really don’t care about justice. It shows that because of people like that, it makes police officers think they can get away with police brutality. If one officer can get off easily from murder then other officers will think that they can get off with basically nothing if they just beat or hit someone just because of whatever the issue such as race, because they’re having a bad day, because the person said something in front of a group of people and the officer feels embarrassed etc. The article also shows another side of opinions other than the ones I’ve presented.

          This articles talks deeper into the subject of police brutality. A term that is not put in the media as much as it occurs. This is what the article is saying. The news and what they put out would quickly say if a black man beat another black man to death without purpose, or a black man beats a white man to death without purpose but wouldn’t necessary put a police officer beats a black man without purpose in the headline. Most of the time viewers have to put two and two together. The news and government try their very best to cover up the wrong doings of policeman. The article also goes into details of a few incidents where police brutality was present, many where there was injustice or the policeman just got off or did very little time, just like the officer who murdered Oscar Grant. The article also brings out how long police brutality has actually been going on, which is since the 1980s. Police departments are always on TV talking about how much they are working forward to make the world a better and safer place but won’t even start that transition within their own department.

 

              This scholarly article relates back to my conflict because I labeled police brutality as the larger conflict of my conflict. It gives a broad outlook on the opinions of it. It shows that everyone is not a blind as they seem. People are really catching on to the police and people will not stand for it for long. just like the people who started riots in Oakland for Oscar Grant, people will start taking action everywhere. The police will not be able to get off so easily sooner or later too many people are aware all over the world. This is also not happening just in one particular state, it’s happening everywhere.

                This article focuses on what the main issue of violence is, how to prevent it, getting help, and psychology tips. The article is really short ye provide links that can be clicked on to go into detail with certain issues and help of prevention of violence. Within the article it tell ways you can tell a situation is about to escalate to violence. It proves that violence could be everything, within your own home, within your friendships, marriage, anything.

              This article reflects back to my conflict because I personally believe that as a policeman you know when a scene is going to turn violent and you know how to approach certain situations. Going back to my conflict, the officer seemed to had let all of his training go out of the window and just acted on the situation on his own. There are qualifications and training that all police officers have to go through before they are just placed on the street and sent to different scenes, everyone knows that. But, in many situations just like my conflict policemen do not always follow through with what they’re taught to do and how they are directed to handle things. How are citizens expected to keep violence off the street when we have to watch our back from the people who are supposed to be protecting us in the first place?

               This article is about police misconduct. Some key points of the article if in the very first paragraph when the author talks about human rights. It states that protecting human rights of the citizens are a part of the everyday duties of an officer. By law, officers are supposed to enforce the law when they’re out there on the streets and in the public. These days, because of many incidents that has happened because of policemen abusing their power, citizens may not even want to get the police involved because they don’t know what the outcome will be. The people should never have to fear the people who are here to protect them, but in this article, it is expressed that this is exactly what it has come to.

             This article relates to my conflict because it just goes to show that people are growing to fear and hate the police. Not many people in the world feel comfortable when the police is around, many tense up. Just like the situation with Oscar Grant, once the police is on the scene you can never actually communicate with police respectfully and get that in return. Police officers always feel like they have something to prove which is where the problems come in. Yes, officers will come across people who are ignorant without purpose but for those who aren’t, like Oscar Grants wasn’t, will still get a weapon waved in their face or verbal abuse screamed at them. It’s obvious that policemen has lost sight in what their actual job is.

This video I am presenting is from YouTube by 4MEGAtainment. The video shows three different videos from the night of the killing of Oscar Grant. The video also shows news reports and Oscars family and parents of his friends speaking on the incident followed by footage from a riot in Oakland provoke because of the killing of Grant and injustice of the verdict. It showed true emotion and passion from people who did know and people who had never met Oscar a day of their life.

I chose two articles, one titled “Fruitvale Station is Loose with the Facts in an Effort to Elicit Sympathy for Oscar Grant” by Kyle Smith and the other “A New Year, and a Last Day Alive” from NY times. Both of these articles were movie reviews in a way but they still tied back into the shooting of Oscar Grant.

  • How are the articles the same? How are they different?

The articles are similar because they both bring up the fact that this movie was released around the time that George Zimmerman was o trial. However, how they differ is that fact that the article written by Kyle Smith thought that the movie was released around the time of the trial to reach out for sympathy and to possibly have an effect on the verdict of Zimmerman. The writer of the NY times article thought that it was good that this movie was released at the time that it was. Even though the story was made public, many people were still clueless about it. The writer thought that it would be good to keep the past injustices relevant so that the Trayvon Martin case wouldn’t go unjust also.

 

  • Do they take a different point of view?

The articles that I chose do take different points of view. The article written by Kyle Smith has a negative perspective on Oscar Grant. He didn’t quite understand the term based on a true story. He stated that a particular scene about Oscar Grant saving a dog in the movie was just a cry for sympathy. He thought that the whole movie was a cry for sympathy. He believed the scenes where Oscar was in jail arrested for possession of a handgun. Also, he believed that part that had something that involved weed. He thought that this was too important of a story for the director to throw in a fiction scene of Oscar “being” an angel saving animals. On the other hand, the other article was very positive. They thought that it was good that the director wanted to express the last hours of Oscar Grants life. The author didn’t focus on the fact that Oscar had been arrested or even had weed in his possession who knows how many times. But, the author pointed out how the movie showed how much he loved his daughter, his family and the real struggles he faced like losing his job but keeping it from his family.

Both of the articles both speak directly from the movie. There were some background information, but it wasn’t stated where it was gathered from.

 

  • Why is this article news? Immediacy, Proximity, Prominence, Uniqueness, Emotion

These articles are ews because of emotion. Both articles express significant amounts of emotion. The article written by Kyle Smith expressed negative and frustrated emotion. He seemed frustrated because he feels like all the wrong and illegal that Oscar Grant did during his life is looked passed. He also sides with the officer who shot and killed Grant when he says that its was an accident. The officer claims that he thought he was reaching for his Taser not his gun.

The other article expresses positive emotion. They are happy that justice is still being fought for and the awareness of Grants story is still spreading even after some time after the incident.

BART Police shooting of Oscar Grant Summary

 

January 1, 2009, 2:5am in Oakland, California, Oscar Grant lll was on his way back from celebrating News Years with a few of his friends. Oscar and his friends boarded a train at the Fruitvale BART station to try to make it home from a night out, but Oscar or his friends saw anything like this coming. Officers stepped on to the train and removed Grant and several others who were suspected of fighting on board. Passengers grew angered when the officers handcuffed Grants friend and the fact that the officers held the train up from leaving the station. One officer on the scene, Jon Woffinden, said “the incident was one of the most frightening h had experienced in his 12 years as a police officer” (Background, nd, para2). Office Pirone, also on the scene directed office Mehserle to arrest two of the males who had not yet been arrested one in which was Oscar Grant. According to officers once Grant over heard that he was under arrest, he attempted to stand up but was slammed on the ground face first. Grant resisted arrest and resisted the handcuffing. However, a cell-phone video broadcast on a local television station on January 23 that shoes officer Pirone charging towards Grant and punching him in the face multiple times before office Mehserle shot Grant. Many people were angered by the incident that took place on this night. Even Grants friends did interviews about how shocked they were that their friend was shot.

January 8, 2009 protestors walked the streets of Oakland holding signs and pictures of Grant. This walk turned into a riot, people smashed hundreds of cars and shop windows. There were at least 105 arrests and over 300 businesses were vandalized.

On January 12, Alameda County Superior Court Judge signed a fugitive arrest warrant. Mehserle was arrested January 13, at a friend’s house in Nevada where he’d gone after he’d started receiving death threats. Mehserle pleaded not guilty, he said that he shot Grant because he felt threatened. However, on November 5, 2010, Mehserle was sentenced to two years with double credit for time already served; reducing his term by 292 days for the 146 days he has already spent in jail. The judge overturned the gun enhancement, which could have added an additional 3 to 10 years to Mehserle’s sentence. Mehserle was released from prison at 12:01 am on June 13, 2011.
